Abortion query

Fatwaa ID: 1582

Question:
Assalamu alaikum

My wife is currently 6 weeks pregnant and this is going to be our 4th child. The issue is that the previous 3 pregnancies were C-section deliveries and it has only been 1 and a half years after the third pregnancy.

My wife gets very diabetic during pregnancy, it was very bad during the last pregnancy and the diabetes has flared up again. She has been very weak ever since her current pregnancy and the doctor said that she would need to be admitted to hospital for 2 or 3 days if she gets sick during pregnancy. This would also make it very difficult for my kids since my oldest is 8 years old. We are also worried that if she is struggling so much now then she will not manage the later stages of the pregnancy.According to the doctor this pregnancy will be very risky for the mother and child. I would like to know if there is leeway for abortion considering the high risk associated with this pregnancy?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We take note of the details of your query. We make du’aa that Allaah Ta’aala grants you strength and comfort and makes it easy for you. May He bless your children.

Islam has sanctified and honored every soul as well as potential soul. Accordingly, abortion has been ruled to be haraam. However, if there is a legitimate Shar’ee reason, i.e. proven or genuinely speculated abnormalities in the fetus, conception through rape or incest or definite permanent health risks for the mother- physical or mental health, then a dispensation may be afforded in the case of a fetus in which the rooh has not yet been breathed, i.e. within 120 days of conception. Beyond 120 days, it will not be permissible under any circumstances.

In the enquired situation, you have not provided sufficient details for us to provide a ruling. The difficulty in raising children is not a valid reason. Sicknesses that are not life threatening or permanent risks do not avail for an exception. Consult with a competent reliable doctor, Muslim if possible, and decide based on the above guidelines.

In all cases, we advise you to place your trust and reliance upon Allaah Ta’aala. Make tawakkul and leave it in His Hands. He is in control of everything. Engage in du’aa and ‘ibaadah.

It should be noted that current medical system encourages and normalizes unnecessary abortions. Hence, it is difficult to take their advice.

And Allaah Ta’aala knows best.
