Question:
Assalamualaikum Mufti saheb What is the rulings regarding poultry farm chickens will it be wazni or adadi

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In regards to poultry animals, the customary practice of the local market place will be considered. In our local markets, some are sold weight based while others are sold by quantity. Both are permissible.

And Allaah Ta’aala knows best.

(ﻭ) ﻛﺒﻴﻊ (ﻟﺤﻮﻡ ﻣﺨﺘﻠﻔﺔ ﺑﻌﻀﻬﺎ ﺑﺒﻌﺾ ﻣﺘﻔﺎﺿﻼ) ﻳﺪا ﺑﻴﺪ (ﻭﻟﺒﻦ ﺑﻘﺮ ﻭﻏﻨﻢ ﻭﺧﻞ ﺩﻗﻞ) ﺑﻔﺘﺤﺘﻴﻦ ﺭﺩﻱء اﻟﺘﻤﺮ ﻭﺧﺼﻪ ﺑﺎﻋﺘﺒﺎﺭ اﻟﻌﺎﺩﺓ (ﺑﺨﻞ ﻋﻨﺐ ﻭﺷﺤﻢ ﺑﻄﻦ ﺑﺄﻟﻴﺔ) ﺑﺎﻟﻔﺘﺢ ﻣﺎ ﻳﺴﻤﻴﻪ اﻟﻌﻮاﻡ ﻟﻴﺔ (ﺃﻭ ﻟﺤﻢ ﻭﺧﺒﺰ) ﻭﻟﻮ ﻣﻦ ﺑﺮ (ﺑﺒﺮ ﺃﻭ ﺩﻗﻴﻖ) ﻭﻟﻮ ﻣﻨﻪ ﻭﺯﻳﺖ ﻣﻄﺒﻮﺥ ﺑﻐﻴﺮ اﻟﻤﻄﺒﻮﺥ ﻭﺩﻫﻦ ﻣﺮﺑﻰ ﺑﺎﻟﺒﻨﻔﺴﺞ ﺑﻐﻴﺮ اﻟﻤﺮﺑﻰ ﻣﻨﻪ (ﻣﺘﻔﺎﺿﻼ) ﺃﻭ ﻭﺯﻧﺎ ﻛﻴﻒ ﻛﺎﻥ ﻻﺧﺘﻼﻑ ﺃﺟﻨﺎﺳﻬﺎ ﻓﻠﻮ اﺗﺤﺪ ﻟﻢ ﻳﺠﺰ ﻣﺘﻔﺎﺿﻼ ﺇﻻ ﻓﻲ ﻟﺤﻢ اﻟﻄﻴﺮ ﻷﻧﻪ ﻻ ﻳﻮﺯﻥ ﻋﺎﺩﺓ ﺣﺘﻰ ﻟﻮ ﻭﺯﻥ ﻟﻢ ﻳﺠﺰ ﺯﻳﻠﻌﻲ ﻭﻓﻲ اﻟﻔﺘﺢ ﻟﺤﻢ اﻝﺩﺟﺎﺝ ﻭاﻹﻭﺯ ﻭﺯﻧﻲ ﻓﻲ ﻋﺎﻣﺔ ﻣﺼﺮ ﻭﻓﻲ اﻟﻨﻬﺮ ﻟﻌﻠﺔ ﻓﻲ ﺯﻣﻨﻪ ﺃﻣﺎ ﻓﻲ ﺯﻣﺎﻧﻨﺎ ﻓﻼ

(ﻭاﻟﺠﺎﻣﻮﺱ ﻣﻊ اﻟﺒﻘﺮ ﺟﻨﺲ ﻭاﺣﺪ ﻭﻛﺬا اﻟﻤﻌﺰ ﻣﻊ اﻟﻀﺄﻥ ﻭاﻟﺒﺨﺖ ﻣﻊ اﻟﻌﺮاﺏ) ﻓﻼ ﻳﺠﻮﺯ ﺑﻴﻊ ﻟﺤﻢ اﻟﺒﻘﺮ ﺑﺎﻟﺠﺎﻣﻮﺱ ﻣﺘﻔﺎﺿﻼ ﻻﺗﺤﺎﺩ اﻟﺠﻨﺲ ﺑﺪﻟﻴﻞ اﻟﻀﻢ ﻓﻲ اﻟﺬﻛﺎﺓ ﻟﻠﺘﻜﻤﻴﻞ ﻓﻜﺬا ﺃﺟﺰاﺅﻫﻤﺎ ﻣﺎ ﻟﻢ ﻳﺨﺘﻠﻒ اﻟﻤﻘﺼﻮﺩ ﻛﺸﻌﺮ اﻟﻤﻌﺰ ﻭﺻﻮﻑ اﻟﻀﺄﻥ ﻓﺈﻧﻬﻤﺎ ﺟﻨﺴﺎﻥ ﻓﺈﻥ ﻗﻠﺖ: ﻟﻢ ﺟﺎﺯ ﺑﻴﻊ ﻟﺤﻢ اﻟﻄﻴﺮ ﺑﻌﻀﻪ ﺑﺒﻌﺾ ﻣﺘﻔﺎﺿﻼ ﻣﻊ ﺃﻧﻪ ﺟﻨﺲ ﻭاﺣﺪ ﻭﻟﻢ ﻳﺘﺒﺪﻝ ﺑﺎﻟﺼﻔﺔ؟ ﻗﻠﻨﺎ ﺇﻧﻤﺎ ﺟﺎﺯ ﻷﻧﻪ ﻏﻴﺮ ﻣﻮﺯﻭﻥ ﻋﺎﺩﺓ ﻓﻠﻢ ﻳﻜﻦ ﻣﻘﺪﺭا ﻓﻠﻢ ﺗﻮﺟﺪ اﻟﻌﻠﺔ ﻓﺤﺎﺻﻠﻪ ﺃﻥ اﻻﺧﺘﻼﻑ ﺑﺎﺧﺘﻼﻑ اﻷﺻﻞ ﺃﻭ اﻟﻤﻘﺼﻮﺩ ﺃﻭ ﺑﺘﺒﺪﻝ اﻟﺼﻔﺔ.
ﻭﻓﻲ اﻟﻔﺘﺢ ﻳﻨﺒﻐﻲ ﺃﻥ ﻳﺴﺘﺜﻨﻰ ﻣﻦ ﻟﺤﻮﻡ اﻟﻄﻴﺮ اﻝﺩﺟﺎﺝ ﻭاﻹﻭﺯ ﻷﻧﻪ ﻳﻮﺯﻥ ﻓﻲ ﻋﺎﺩﺓ ﺃﻫﻞ ﻣﺼﺮ ﺑﻌﻈﻤﻪ.
