Deceased mother’s jewelry and gold

Fatwaa ID: 1297

Assalamualaykum Respected Mufti Saab. How is a mothers fine jewellery/gold distributed after her passing.

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

The mother’s wealth, which includes all her jewelry, will form part of her estate. It will then be distributed according to the Shari’ah laws of succession and inheritance. The jewelry will not go to the daughters only as commonly done in some cultures. The sons and husband too have a share in it. The daughters will not receive any preference in this regard either. If the mother had made a bequest or stipulated something for the daughters, then that will be invalid and thus ignored. You may list the survivors and we will advise regarding the exact distribution.

And Allaah Ta’aala knows best.
