mere fufizad bhai A.Shafi ne apni biwi saleha se 10 sal pehle ye kaha tha ki shaheen se bat karegi to tujhe 3 talaq,
aaj 10 sal bad saleha apni saheli k sath bazar ja rahi rhi k shaheen ne saleha ki saheli se thele k bare me puchha k kafi bada thela he.lekin saleha jo k ulti taraf dekh rahi thi use pata nahi tha k shaheen he,usne jawab diya k “haa,bada he”lekin jaise hi malum hua k shaheen he to chup ho gai.or saanp sungh gaya.
ab malum ye karna tha k kya anjane me k us se bat karne ka irada bhi nahi tha bat ho gai to kya talaq waqe ho jaye gi?

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
We take note of the details of your query. We understand that A. Shafi told his wife, Saleha, that if she speaks to Shaheen, then three talaaqs will occur. Saleha upheld that and refrained from speaking to her for 10 years. However, recently, she ended up accidentally speaking to Shaheen, assuming her to be someone else.
At the outset, we wish to point out that the husband issuing such a conditional divorce 10 years ago was foolish. The words of divorce are sensitive and consequential. One was enough. There was no need for three. Nevertheless, in the enquired situation, the three talaaqs have occurred as the condition was met, i.e., speaking to Saleha. They must separate with immediate effect. Her ‘iddah has commenced from the time she spoke to Saleha.
The three talaaqs constitute a permanently irrevocable divorce (talaaq mughallazah). They cannot reconcile unless a valid halaalah is found.
