Donations being used for other than the collected purpose

Fatwaa ID: 2145

Question:
Assalamu alaikum.
Respected Muftisaheb.
A while ago, I donated money to a local organisation that was collecting money for homeless people in a specific area, due to wildfires ravaging their homes.
A month later, they said that they diverted some of the monies for their other causes.
Is this permissible for them to do?
Jazakallah khairan.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, when donating nafl sadaqah to an organization, you are either making them the owners of the funds and they then use it as they deem best or you are appointing them as your representative (wakeel). In most cases, it is the former that happens. This gives the organization more flexibility and discretion over the funds. In the latter case, they must do as instructed by the doner.

In the enquired situation, it is not clear which scheme was implemented by the organization you donated to. If it was the former, then they would have the right to divert the funds elsewhere for other causes. However, it would be in their best interest to inform or consult with the donors that have trusted them. If it was the latter, then they may not divert the funds elsewhere unless permission is found from the donor.

And Allaah Ta’aala knows best.
