Extra item in a box of purchased goods

Fatwaa ID: 2314

Question:
السلام علیکم ورحمة الله وبركاته

If one purchased a box of juice and on the box it says 12 pouches are within the box, but once opened, the customer finds that there’s 14 instead of 12, what should be done?

They have emailed the manufacturers telling them that they’ve received two extra pouches inside as a mistake, whilst they’ve paid for the box of 12. The manufacturer has not replied for 3 weeks.

Is it halaal to consume those two extra pouches? What should be done with them?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We commend you for your honesty and Allaah-consciousness.

If a person purchases something specified but thereafter finds that he was given something more or extra, then he must reach out to the seller and return the extra item(s). If the seller allows him to keep it, then he may keep it. There is no need to reach out to the manufacturer unless he purchased it from them directly. His interactions are with the seller.

And Allaah Ta’aala knows best.
