Following the person next to you if you forget how many rak’ahs you missed

Fatwaa ID: 682

Question:
AssalamuAlykum
A person (let’s say Abdullah) joins the salat in jamat as masbooq (late comer). After Imam ends the Salat with Salam, he stands up to continue his remaining salat but (due to the negligence and lack of devotion)he is not sure how many rakaats he missed. However he is sure that person standing next to him (let’s say AbdurRehman) joined the same rakaat or one rakaat after him.
Can Abdullah complete his missed rakaats on the basis of AbdurRehman’s salat? by having an idea from the movements that AbdurRehman is making without directly looking at him, however he may have to adjust his speed to see how many rakaats AndurRehman will pray after imam finishes his Salah.
(And later on he confirms that AndurRehman was sure about his number of rakaats)
Is Abdullah’s salah valid in this situation?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

The above will be permissible. His salaah will remain valid. However, he should make istighfaar for being unmindful in his salaah.

And Allaah Ta’aala knows best.
