Hadd punishment, shaming people

Fatwaa ID: 1806

Question:
In regards to this;
I don’t have any knowledge about HADD ,can you please tell me what that is and if someone only makes tawbah and asks for Allah swt for forgiveness constantly,will that suffice.
Please know the person in question has been insulted repeatedly and shamed,
Is that punishment enough?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

Hadd refers to the penal punishments executed by the Islamic state for various crimes. In our current times, we do not have an Islamic state. Hence, the hadd punishments cannot be executed. One will make sincere tawbah and istighfaar for his sins.

It should be noted that it is haraam for the public to insult and shame a person for his/her sins. Shaming and insulting a person is not a punishment but rather a crime, for which its perpetrators will be accountable on the Day of Judgment. It is sad to note that you have referred to it as a punishment and seem to justify it. Istighfaar and tawbah should be made for this claim and/or understanding.

And Allaah Ta’aala knows best.
