Hajj badal for parents who are alive

Question:
Asalamoalaykum,

My father and mother are almost 80 years old. My mother has arthritis and has walking problem and so as my father. Both has limited mobility. They are both retired and have not performed hajj so far.

Question 1: Is Hajj Fard on them?
Question 2: If they have to perform hajj. Do they have to go personally or can they do Hajj – e – badal (someone else performing hajj on their behalf). Is Haj – e – badal valid from islamic jurisprudence perspective?

In the Name of Allaah, the Most Gracious, the Most Merciful.

May Allaah Ta’aala bless your parents with a long life filled with khayr and ‘aafiyah.

  1. The obligation of Hajj on them is dependant on their previous condition. If they had the physical ability previously to go and also the financial ability, then Hajj has been fardh on them since then. The obligation does not get waived because they lost their physical or financial ability. The obligation remains standing until performed.
  2. If Hajj is fardh on them and they are physically unable to go and also have no hope of being able to go in the future, then they must try to get someone to perform Hajj on their behalf. Istighfaar should be made in this case.
