Question:
Assalam o alaikum respected Mufti Sahab,
If someone asks you to do hajj for a deceased person but that person did not do wasiyat, nor made any contribution towards the cost of the hajj, can the hajj still be done on their behalf, or should you just do nafil hajj and send reward to everyone including the deceased person?
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
Hajj Badal, i.e., Hajj on behalf of someone, may be done even if the deceased did not make a wasiyyah for it nor contributed towards the cost. However, the cost in such a case will not be taken from the estate.
And Allaah Ta’aala knows best.
