Question:
As-salāmuʿalykum wa raḥmatullāhi wa barakātuh,
I would like to confirm if the below is correct regarding a woman having to pay for her maḥrams ḥajj expenses and if ḥajj is farḍ on her when she is unable to provide for both her and his expenses:
If the maḥram HAS done his own farḍ ḥajj then you will be liable to pay for his expenses hence ḥajj will only be farḍ if you are able to pay for both of you. However, if he is willing to accompany you and pay for his expenses in this case ḥajj will be farḍ upon you as you have the means of performing it.
If the maḥram has NOT done his own farḍ ḥajj he will have to pay for his own expenses.
There also exists the option of performing ḥajj with another maḥram who has not performed ḥajj if you are unable to provide for both.
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
We take note of the details of your query. The above is not correct.
For the obligation of Hajj on a woman, the general prerequisites applicable to men must be met. Along with that, her husband or a mahram must accompany her if the distance is that of safar. Likewise, she must have the financial ability to cover his cost along with hers. It is not necessary for the husband or the accompanying mahram to be a non-first timer nor is it necessary for him to cover his own cost if it is his first time. If she covers his cost, then the Hajj will suffice for him in fulfilling his lifetime obligation. Notwithstanding this, it is advisable that he pays for his own Hajj if he has the means to do so. If he chooses to voluntarily and willingly pay for her Hajj as well, then that is permissible and he will be rewarded.
And Allaah Ta’aala knows best.
