Hanafi behind Shaafi’ee in Witr Salaah

Question:
السَّلاَمُ عَلَيْكُمْ وَرَحْمَةُ اللهِ وَبَرَكَاتُهُ

Mufti SB

Can a hanafi read Salah behind a shafee Imaam? Or do we have to read Witr on our own in Jamaat

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

If the Shaafi’ee imaam is performing all three rak’ahs of Witr together with one set of Salaam, then a Hanafi may join and that will be sufficient for him. There is no need to have two separate congregations.
If the Shaafi’ee imaam is performing two plus one, with two sets of Salaam, then that will not count as Witr for the Hanafi follower. He may however join the congregation with the intention of nafl. After the one rak’ah, he should add a second rak’ah. Afterwards, he must perform the Witr Salaah in the manner acceptable by the Hanafi legal school. If there are a few people, it may be done in congregation.

الدر: (ﻭﺻﺢ اﻻﻗﺘﺪاء ﻓﻴﻪ) ﻓﻔﻲ ﻏﻴﺮﻩ ﺃﻭﻟﻰ ﺇﻥ ﻟﻢ ﻳﺘﺤﻘﻖ ﻣﻨﻪ ﻣﺎ ﻳﻔﺴﺪﻫﺎ ﻓﻲ اﻷﺻﺢ ﻛﻤﺎ ﺑﺴﻄﻪ ﻓﻲ اﻟﺒﺤﺮ (ﺑﺸﺎﻓﻌﻲ) ﻣﺜﻼ (ﻟﻢ ﻳﻔﺼﻠﻪ ﺑﺴﻼﻡ) ﻻ ﺇﻥ ﻓﺼﻠﻪ (ﻋﻠﻰ اﻷﺻﺢ) ﻓﻴﻬﻤﺎ ﻟﻻﺗﺤﺎﺩ ﻭﺇﻥ اﺧﺘﻠﻒ اﻻﻋﺘﻘﺎﺩ

ح: (ﻗﻮﻝ ﻋﻠﻰ اﻷﺻﺢ ﻓﻴﻬﻤﺎ) ﺃﻱ ﻓﻲ ﺟﻮاﺯ ﺃﺻﻞ اﻻﻗﺘﺪاء ﻓﻴﻪ ﺑﺸﺎﻓﻌﻲ ﻭﻓﻲ اﺷﺘﺮاﻁ ﻋﺪﻡ ﻓﺼﻠﻪ، ﺧﻼﻓﺎ ﻟﻢا ﻓﻲ اﻹﺭﺷﺎﺩ ﻣﻦ ﺃﻧﻪ ﻻ ﻳﺠﻮﺯ ﺃﺻﻼ ﺑﺈﺟﻤﺎﻉ ﺃﺻﺤﺎﺑﻨﺎ ﻷﻧﻪ اﻗﺘﺪاء اﻟﻢﻓﺘﺮﺽ ﺑﺎﻟﻢﺗﻨﻔﻞ، ﻭﺧﻼﻓﺎ ﻟﻤﺎ ﻗﺎﻟﻪ اﻟﺮاﺯﻱ ﻣﻦ ﺃﻧﻪ ﻳﺼﺢ ﻭﺇﻥ ﻓﺼﻠﻪ ﻭﻳﺼﻠﻲ ﻣﻌﻪ ﺑﻘﻴﺔ اﻟﻮﺗﺮ ﻷﻥ ﺇﻣﺎﻣﻪ ﻟﻢ ﻳﺨﺮﺝ ﺑﺴﻼﻡﻫ ﻋﻨﺪﻩ ﻭﻫﻮ ﻣﺠﺘﻬﺪ ﻓﻴﻪ ﻛﻤﺎ ﻟﻮ اﻗﺘﺪﻯ ﺑﺈﻣﺎﻡ ﻗﺪ ﺭﻋﻒ.
ﻗﻠﺖ: ﻭﻣﻌﻨﻰ ﻛﻮﻧﻪ ﻟﻢ ﻳﺨﺮﺝ ﺑﺴﻼﻣﻪ ﺃﻥ ﺳﻼﻣﻪ ﻟﻢ ﻳﻔﺴﺪ ﻭﺗﺮﻩ ﻷﻥ ﻣﺎ ﺑﻌﺪﻩ ﻳﺤﺴﺐ ﻣﻦ اﻟﻮﺗﺮ، ﻓﻜﺄﻧﻪ ﻟﻢ ﻳﺨﺮﺝ ﻣﻨﻪ، ﻭﻫﺬا ﺑﻨﺎء ﻋﻠﻰ ﻗﻮﻝ اﻟﻬﻨﺪﻭاﻧﻲ ﺑﻘﺮﻳﻨﺔ ﻗﻮﻟﻪ ﻛﻤﺎ ﻟﻮ اﻗﺘﺪﻯ ﺇﻟﺦ، ﻭﻣﻘﺘﻀﺎﻩ ﺃﻥ اﻟﻤﻌﺘﺒﺮ ﺭﺃﻱ اﻹﻣﺎﻡ ﻓﻘﻂ، ﻭﻫﺬا ﻳﺨﺎﻟﻒ ﻣﺎ ﻗﺪﻣﻨﺎﻩ ﺁﻧﻔﺎ ﻋﻦ ﻧﻮﺡ ﺃﻓﻨﺪﻱ.
