Haydh query

Question: Asalaamu alakuim

I hope that Hazrat is well..

This is how I came to 10 days

19th February zuhar till 20th February zuhar is = day one

20th -21st = day two

21st – 22nd =day three

22nd – 23 rd= day four 

23-24 th = day five

24-25 th = day 6

25-26th =day 7

27-28 = day 8

28_29= day 9

29-1st @ zuhar is 10 days..Perhaps I am wrong please advise

I have recorded previous habits. i sent the email to the darul iftaa last year and didn’t get a reply..Will resend inshallah.

I think the main problem was I didn’t have some details the last time..I send inshallah

This is my previous correspondence for which I am still awaiting a reply..I have tried to email that email address but didn’t receive a reply.

.I have learnt to have a proper record from then..alhamdulilah

The last hadih before this was in ramadhaan 10 days …the clean days was different for every month…extremely irregular…some months regular and some months would not experice haidh at all…
This is how it was from ramadhaan…
Ramadhaan 10 days … From these 10 days there was spotting before an after..hence counted as part of haidh..
That was my last proper haidh….

Follow up:

Assalamualikum warahmatullahi wabarakatuh.

We required a clarification, 

Can you please let us know of the duration of your menses and clean cycles for the last three or two months before your continuous spotting?

If you have not recorded, then at least let us know the duration of your menses and clean cycles right before the spotting began?

Kindly Acknowledge receipt and reply as soon as possible.

I hope that this email finds Mufti I the best of health…

I had sent a query previously and haven’t received a reply.Perhaps it was sent and I didn’t receive it. I sent the details in a previous email.

Please advise on my current situation:

February 2017

19th Sunday commenced at zuhar time. By the night experienced brown and was clean till next day esha.

Thereafter Haidh commenced on the Monday as normal..Ghusal on the 1st March.

March 2017

1 March..Ghusal at zuhar time .

1-15 March spotting red in these days.

16 zuhar expiry of 15 days .spotting continued till 21 March 2017.

Haidh commenced on the 22 March 2017.

Ghusal on the 28th March 2017.

29-31 March absolutely clean.

April..

1-10 =clean

11-12 red spotting

15 days completed on the 12th.

12th till 22nd haidh

23-24_24 April spotted

26_30 no spotting absolutely clean

May 

1 May clean

2&3 May spotted.

4-9 May clean

10-12 spotted

13 &14 clean

15 spotted

Haidh starts from 16 May & finishes on the 26 May.

27 – 31 May absolutely clean.

June 

1-12 June absolutely clean..(15 days finished on the 10th)

13th spotted once

14 -15-16 June clean

17 June spotted once 

##spotting is red and once only in the day..Sometimes just one spot and then absolutely clean.

Spotting slightly more on the 19

Regarded as haidh..ghusal on the 29 June.

After these days experienced haidh like red spotting and a bit of bleeding more than the above ten days .considered istihaadah.forgot to record when it finished and normal clean days started.

July..

After the above days clean days resumed.

18th spotting

19-20 clean

21-spotting a little more.Regarded as haidh..Regarded it as till 28 10 days ghusal.

On Saturday 30 July bleeding as normal haidh…considering it as istihaadah..

Please can mufti help me to determine what us haidh and istihaadah.

It would be appreciated if I can get the answer quickly so there is no delay :/ the qadhaa salaah etc..

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Dear sister,

We apologize for the inconvenience. Considering the abovementioned details, your days are as follows:

  • Feb 19 Zuhr to March 1 Zuhr was haidh
  • March 1 Zuhr to March 16 Zuhr was tuhr
  • March 16 Zuhr to March 26 Zuhr was haidh
  • March 26 Zuhr to April 10 Zuhr was tuhr
  • April 10 Zuhr to April 20 Zuhr was haidh
  • April 20 Zuhr to May 14 Zuhr was tuhr
  • May 14 Zuhr to May 24 Zuhr was haidh
  • May 24 Zuhr to June 16 Zuhr was tuhr
  • June 16 Zuhr to June 27 Zuhr was haidh
  • June 27 Zuhr to July 21 Zuhr was tuhr
  • July 21 Zuhr to 30 Zuhr was haidh. If you bled on the 31st, then it will be haidh as well.
  • The next 15 days thereafter will be tuhr

Note: If you spot blood any time during the tuhr cycle, it will be considered istihaadhah.

The principles used to determine the above ruling are as follows:

The minimum period for a menstrual cycle is three days and the maximum period is ten days[i]. Any blood for lesser than three days or more than ten days will be considered istihaadhah (abnormal vaginal bleeding)[ii]. The minimum period for clean days (tuhr) is fifteen days[iii] while there is no maximum period for a clean period[iv]. After fifteen days, one will see if there is any blood. If there is, then if it is for three days or more then it will be considered haidh. If it is lesser than three days, it will be considered istihaadhah. One will continue counting tuhr until she sees three days or more of blood. Any blood she sees during the tuhr period will be regarded as istihaadhah.   

You should use the above principles to decide on your future haidh and istihaadhah.

وأقل ما يكون الحيض ثلاثة أيام ولياليها, لا ينقص من ذلك شيئاً، وأكثر الحيض عشرة أيام ولياليها, لا يزيد على ذلك شيئاً.

الأصل للشيباني 2/ 14

لأن الحيض لا يكون أقل من ثلاثة أيام

الاختيار لتعليل المختار (1/ 26)

قَالَ: (وَأَقَلُّ الْحَيْضِ ثَلَاثَةُ أَيَّامٍ وَلَيَالِيهَا، وَأَكْثَرُهُ عَشَرَةٌ بِلَيَالِيهَا) لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -: «أَقَلُّ الْحَيْضِ لِلْجَارِيَةِ الْبِكْرِ وَالثَّيِّبِ ثَلَاثَةُ أَيَّامٍ بِلَيَالِيهَا، وَأَكْثَرُهُ عشَرَةُ أَيَّامٍ بِلَيَالِيهَا»

كنز الدقائق (ص: 149)

وأقلّه ثلاثة أيّامٍ وأكثره عشرةٌ وما نقص أو زاد استحاضةٌ

مختصر القدوري (ص: 19)

أقل الحيض ثلاثة أيام ولياليها. وما نقض عن ذلك فليس بحيض وهو استحاضة. وأكثر الحيض عشرة أيام ولياليها وما زاد على ذلك فهو استحاضة.

فنقول: أكثر الحيض عشرة أيام

وَ(أَقَلُّهُ ثَلَاثَةٌ بِلَيَالِيِهَا) الثَّلَاثِ، فَالْإِضَافَةُ لِبَيَانِ الْعَدَدِ الْمُقَدَّرِ بِالسَّاعَاتِ الْفَلَكِيَّةِ لَا لِلِاخْتِصَاصِ، فَلَا يَلْزَمُ كَوْنُهَا لَيَالِيَ تِلْكَ الْأَيَّامِ؛ وَكَذَا قَوْلُهُ (وَأَكْثَرُهُ عَشْرَةٌ) بِعَشْرِ لَيَالٍ، كَذَا رَوَاهُ الدَّارَقُطْنِيّ وَغَيْرُهُ. (وَالنَّاقِصُ) عَنْ أَقَلِّهِ (وَالزَّائِدُ) عَلَى أَكْثَرِهِ أَوْ أَكْثَرِ النِّفَاسِ أَوْ عَلَى الْعَادَةِ وَجَاوَزَ أَكْثَرَهُمَا . (وَمَا تَرَاهُ) صَغِيرَةٌ دُونَ تِسْعٍ عَلَى الْمُعْتَمَدِ وَآيِسَةٌ عَلَى ظَاهِرِ الْمَذْهَبِ (حَامِلٌ) وَلَوْ قَبْلَ خُرُوجِ أَكْثَرِ الْوَلَدِ (اسْتِحَاضَةٌ).

ودم الإستحاضة هو ما تراه المرأة أقل من ثلاثة أيام أو أكثر من عشرة أيام فحكمه حكم الرعاف الدائم: لا يمنع الصوم ولا الصلاة ولا الوطء.

كنز الدقائق (ص: 150)

وأقلّ الطّهر خمسة عشر يومًا ولا حدّ لأكثره إلّا عند نصب العادة في زمان الاستمرار

لأن الحيضتين لا يكون بينهما من الطهر أقل من خمس عشرة ليلة.
