Husband’s responsibility to purchase a home for the wife

Fatwaa ID: 330

Question:
Assalamualaikum, is it the husbands responsibility islamically to purchase a home and is the wife’s name on the house on it as well?
Or does she need to contribute for the house to be in her name?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

It is the husband’s responsibility to provide adequate living space to his wife in accordance to his financial capability. He does not have to purchase a home for himself nor for her. If he does purchase a home, he does not have to add the wife’s name to the house as a co-owner. The house belongs to him unless he chooses to voluntarily gift it or a portion of it to the wife. It should be noted that merely adding the wife’s name would not necessitate ownership unless a valid gifting or partnership is found. If she contributes to the purchase of a house, then the ownership would be according to the mutually agreed ratio.

And Allaah Ta’aala knows best.
