‘Iddah after 16 years

Fatwaa ID: 1808

Question:
السَّلَامُ عَلَيْكُمْ وَرَحْمَةُ ٱللَّهِ وَبَرَكاتُهُ

If a woman and her husband have been separated for 16 years
No contact
No reason to reconcile
No doubt of paternal issue and no mourning as the husband is alive

But the wife now seeks a divorce
Not to remarry

But for her personal reasons of moving on

Does she still have to fulfill her responsibility of iddat 16 years later ?

Disclaimer: the lady is 54 years old

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

‘Iddah post divorce is obligatory upon the divorced woman irrespective of how long a couple may have been separated prior to the divorce. Her ‘iddah will be the same as others, three menstrual cycles. Apart from the many wisdoms of ‘iddah and its legislation, it is also a form of ‘ibaadah. A woman is rewarded for dutifully observing the ‘iddah.

And Allaah Ta’aala knows best.
