Iddah of khula’, Khalwah

A sister asks:

  1. How long is the iddah of khula?
  2. What is considered as consummation of marriage for iddah to take place?

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

  1. The ‘iddah of khula’ is the same as that of talaaq, i.e., three menstrual cycles unless the wife is pregnant, in which case until childbirth.
  2. Consummation of marriage or khalwah saheehah refers to unrestricted valid seclusion wherein the couple are able to engage in penetrative intimacy without the fear or possibility of interference from others. Khalwah and consummation, according to the Hanafi legal school, is established irrespective of whether intimacy is found or not.
