Question:
Asalamualaikum Mufti Saab
If a female child’s lineage is cut off from her biological father (ie. in the case of the female child being born out of wedlock), will this child still maintain the mahram relations with her biological father and the biological father’s sons.
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
In regards to the father of an illegitimate child, he will be classified as a mahram. However, he should not travel with her as a mahram. Likewise, modesty and caution should be advised in his presence.
As far as the sons of her biological father, they would not be mahrams to her. The laws of hijaab will be applicable. However, marriage between them will be impermissible.

قوله (ومع زوج أو محرم) هذا وقوله ومع عدم عدة عليها شرطان مختصان بالمرأة فلذا قال لامرأة وما قبلهما من الشروط مشترك والمحرم من لا يجوز له مناكحتها على التأبيد بقرابة أو رضاع أو صهرية كما في التحفة وأدخل في الظهيرية بنت موطوءته من الزنا حيث يكون محرما لها، وفيه دليل على ثبوتها بالوطء الحرام، وبما تثبت به حرمة المصاهرة كذا في الخانية نهر
لكن قال في شرح اللباب ذكر قوام الدين شارح الهداية أنه إذا كان محرما بالزنا فلا تسافر معه عند بعضهم، وإليه ذهب القدوري وبه نأخذ اهـ وهو الأحوط في الدين والأبعد عن التهمة. اهـ
