Inheritance query

Fatwaa ID: 393

Asalamualaikum Mufti Sahib.

I have a question regarding Inheritance.

A father passed away, his inheritance was distributed amongst his children according to the Shariah.

Some of his Inheritance ie land was not sold at that time and now (after some years) it has been sold and that money will be distributed, but one of his sons have passed away in those years.

My question is will the Inheritance portion of that son (who has passed away) be given to his wife?

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

May Allaah Ta’aala full booth of their qabrs with noor and elevate their statuses in Jannah.

The proceeds from the land will be distributed as the estate was distributed previously. As for the deceased son’s share, it will be distributed according to his estate division. It will not be given to his wife only but to all his heirs, pro rata their respective shares.

And Allaah Ta’aala knows best.
