Inheritance query: 3 daughters, 6 grandchildren

Fatwaa ID: 1691

Question:
Salaam Mufti Saab. Please may I ask a question in regards to inheritance please.

My mother recently passed away (ILWIIR).

She had 3 daughters.
She also had 6 grandchildren (5 grandsons, 1 granddaughter)

She had no sons and no husband (previously divorced and he has also passed away).

Her siblings are 2 brothers and 2 sisters. She also has 1 half brother and 2 half sisters.
No living parents

What is the ruling please for the inheritance and what percentage shares do each beneficiary get?

Jzk

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

May Allaah Ta’aala shower upon your mother with His infinite mercy and grace and elevate her status in Jannah. May He grant you and the family sabr jameel.

We have been advised that the deceased is survived by three daughters, five maternal grandsons, one maternal granddaughter, two full brothers, two full sisters, one half brother (maternal or paternal) and two half sisters (maternal or paternal).

Accordingly, after funeral expenses, debts and bequests, the estate, which is inclusive of ALL of the deceased’s belongings irrespective of how insignificant such as clothing, beauty and hygiene products, etc., will be divided into 18 shares as follows:

-The daughters will receive 4 shares (22.22%) each.
-The full brothers will receive 2 shares (11.11%) each.
-The full sisters will receive 1 share (5.56%) each.

-The maternal grandchildren and the half siblings will not receive anything.

Disclaimer: The above calculations are based on the information provided. If there are other heirs, then the above may not be applicable. If any heir had passed away in the interim, then the above may not be applicable as well.

And Allaah Ta’aala knows best.
