Inheritance query: wife and 2 daughters and a brother

Fatwaa ID: 1431

Salaam alaikum ,
If a man dies leaving a wife and 2 daughters and a brother. How will the inheritance be distributed according to the Quran.JazakAllah khair in advance.

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

May Allaah Ta’aala shower upon him with his infinite mercy and grace and elevate his status in Jannah. May He grant you and the family sabr jameel.

We have been advised that the deceased is survived by his wife, two daughters and one brother. Accordingly, after funeral expenses, debts and bequests, the estate, which is inclusive of ALL of the deceased’s belongings irrespective of how insignificant such as clothing, beauty and hygiene products, etc., will be divided into 24 shares as follows:

-The wife will receive 3 shares (12.5%).
-The daughters will receive 8 shares (33.33%) each.
-The brother will receive 5 shares (20.83%).

Note: Due to the intricacies of rounding off each beneficiary’s percentage share to the nearest decimal point, there is a remainder of 0.01%. This minute amount of the estate will be left over after distribution. This can either be given away in charity on behalf of the deceased with the consent of all the heirs or it can be given to any of the heirs with the permission of the others; otherwise it will have to be redistributed according to the above percentages as far as possible.

Disclaimer: The above calculations are based on the information provided. If there are other heirs, then the above may not be applicable. If any heir had passed away in the interim, then the above may not be applicable as well.

And Allaah Ta’aala knows best.
