Question:
Assalaamu Alaykum,
Somebody had a car crash where the car behind hit them but the passenger inside wasn’t hurt, due to the harsh brake their head hit the seat, but the most they went through was shock and a bit of anxiousness would it be permissible for the passenger inside the car that got hit to claim?
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
We take note of the details of your query. In the event of a car crash or accident, one may claim reimbursement for any damages, genuine tangible losses, expenses and costs related to the accident. It will not be permissible to claim for potential loss or non-tangible harms or difficulties. Shock and anxiousness are not valid issues to claim financial reimbursements for. It will not be permissible for the passenger in the enquired situation to make any claims. Similarly, the driver and/or others must ensure that their claims are valid according to the Shari’ah. Any extra amount claimed will have to be returned or given away in charity.
