Invested in Shariah non-compliant stocks

Fatwaa ID: 2184

Assalamualaikum mufti sab, I’m currently invested into a stock and it’s not shariah compliant, let’s say I were to make 5k profit on it and 50% of it is not earn halal through the company, could I give that to my family because they need it, I know with Haram money you must sell it and donate it, but if I were to do that ill lose money, also the stock is t2 biosystems. Assalamualaikum

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We commend you for trying right the wrong. May Allaah Ta’aala place barakah in your wealth. It is of utmost importance that our investments and sources of income are halaal. This has an effect on our life and worship. It is unfortunate that most people invest in various avenues without verifying the Shari’ah compliance of it.

If a person invests in a Shari’ah non-compliant stock, then he must sell it and come out of it. He may keep his capital. Likewise, he may keep the profits from the Shari’ah compliant ratio of the company. The remaining, which is Shari’ah non-compliant, must be given away in charity to the poor and needy without any expectation of reward.

And Allaah Ta’aala knows best.
