Is my nikaah valid?

Fatwaa ID: 1455

Question:
Assalamualaikum, a girl wants to know whether her nikah is valid or not.

When her family found the guy for her the father asks if she’s okay with the family and she says she’s ok to move forward.

fast forward to the nikah the wali of the girl doesn’t ask his daughter that “do u accept him in marriage” but the guy reading the nikah only ask the groom because the wali of the girl told them that he already got permission. No one asked the girl on her nikah day for permission but in her head she was thinking “I accept too”

is their nikah valid?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

A nikaah takes place with a valid eejaab/proposal and acceptance/qabool. The proposal and acceptance may be done by the groom and bride or their representatives. In the enquired situation, it seems that the father/wali took permission or consent from the daughter to proceed with the ceremony. That is the traditional way. He then either represented her or appointed the officiant as her wakeel/representative. That is permissible and the nikaah would be valid in this manner. The bride does not need to be asked again during the ceremony. If this was the case in the enquired situation, then the nikaah is valid.

And Allaah Ta’aala knows best.
