Istisnaa’ business

Question:
salaam,

is the following business halal?

1) A supplier makes Foot ball t shirts with personalised names.
2) a middle man advertises those shirts for sale.
3) a customer then purchases the shirts from the middle man and pays him.
4) after purchase, the middle man informs the supplier, who makes the T-shirt and pays for it.
5) the T shirt is sent to the middle man who passes it onto the customer, or the supplier posts it directly to the customer.

if this is not permissible, what tweaks / changes could be made to make it permissible

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We take note of the details of your query. In step 5, it will not be permissible for the supplier to deliver it to the customer directly unless there is a third person who may assume position of the item first on behalf of the middleman. Aside from this, it will be necessary to let the customer know that the seller/middleman does not have the item yet; the order will only be fulfilled once ordered. If the above two things are corrected, then the business will be permissible.
