Items left behind by workers, by theives

Workers at a factory left work due to covid n left their work clothing at the factory. It’s been 3 years n no one had claimed the items. Will it be permissible for the factory owner to give the items away

During a break in at the same factory some tools were left behind by the thieves
Can these be given away too

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

  1. We understand that the clothing belong to the workers, not the factory. We also understand that the factory owner has lost hope of them coming and picking up their clothing. Accordingly, the factory owner may give the clothing away in charity on behalf of the workers. However, unless they agreed to it, should the workers come and demand for their clothing later on, the owner will have to reimburse them.
  2. If the thieves have stolen goods equivalent to or more than the value of the tools, then the factory may keep the tools or sell them to recover their loss and/or to repair the damage. Any amount remaining after recovering the loss will have to be given away in charity. If there was no loss, then the factory owner may give away the tools on their behalf. However, in the unlikely case they come and ask for their tools, they will have to be reimbursed.
