Janaazah for drowned person whose body has not been found

Fatwaa ID: 1722

Question:
Slm. What is the different Madhaaib view point on Salaatul Janaazah for a drowned person? How does a family get closure on this matter even after the search parties calls off the search? The Muftiyaan Kiraam views will kindly appreciated.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

According to the Hanafi legal school, the body must be physically present in order to perform the Janaazah Salaah. The Shaafi’ee legal school however permits Janaazah in absentia. In the enquired situation, there is no Janaazah Salaah for the person in reference according to the former position. The family and loved ones however are encouraged to make du’aa for him. That is beneficial for him.

A person who drowns is a shaheed. His rewards are tremendous in the eyes of Allaah Ta’aala. He is surely in a better place. The bereaving family should take this as solace and hope for rewards from Allaah Ta’aala. May Allaah Ta’aala make it easy and grant the family Sabr Jameel.

And Allaah Ta’aala knows best.
