Jumping the turnstiles in the subway and evading MTA fares

Fatwaa ID: 1709

Question:
Selam Alejkum va rahmetullah respected scholars, I pray this question finds you well.

It’s common for people to avoid paying subway fares by hopping turnstiles or walking through the emergency door that happens to be open. It seems somewhat dishonest and is possibly theft but I just wanted to make sure that this was actually the case.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

A Muslim is honest and truthful in all matters of his life. He lives an honorable life. He is not deceitful nor does he cheat anyone. These are characteristics of a hypocrite. A person who cheats is deprived of khayr and barakah.

It is not permissible to jump the subway turnstiles. Likewise, it is not permissible to walk through the emergency doors when open. The subway fares are legitimate service fees. One will be sinful for jumping the turnstiles and/or evading the fares. Furthermore, doing the above puts a person at risk of legal troubles and humiliation.

And Allaah Ta’aala knows best.
