Jumu’ah of a Shafi’ee if less than 40; Musaafir according to the Shafi’ee madhab

Question:

A.A.W.W,
I pray you are in the best of health

My question is in regards to Jummah prayer, we pray with jammat at work. However there is only about 25 of us, one of the brothers is a follower of Shafee mazhab. He has queried whether he still prays behind us to partake in the reward of congregation or prays Zohr alone? according to Imam Shafiee
rahimaullah 40 people are required.

Secondly according to Shafiee mazhab, when is a person classed as a musafir?

Answer:

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Brother in Islam,

  1. In principle, according to the Shafi’ee madhab, a congregation of forty is a requirement for the validity of the Jumu’ah salaah[1]. Hence, if the congregation at your place does not reach forty, the brother in reference will have to find an alternative congregation reaching the minimum limit of forty. It will not be permissible for him to leave out the Jumu’ah salaah and pray Zuhr instead. Jumu’ah salaah is an obligation upon every sound, healthy and residing Muslim[2]. It is not permissible to leave out the Jumu’ah salaah without a valid Shar’ee reason.
  2. A musaafir is one who leaves his city limits, intending to eventually travel the safar distance for a lawful act[3].

أما حكم المسألة فالجمعة فرض عين على كل مكلف غير أصحاب الأعذار والنقص المذكورين هذا هو المذهب وهو المنصوص للشافعي في كتبه وقطع به الأصحاب

فقال أصحابنا لا يجوز القصر إلا في سفر يبلغ ثمانية وأربعين ميلا بالهاشمي سواء في هذا جميع الأسفار المباحة هذا هو المذهب وبه قطع الجمهور
