Kissing while fasting

Question:
asalamualaikum wrwb

a sister has asked the following question

If a husband and wife kiss while fasting, and the saliva of the spouse is swallowed by the other spouse, unintentionally, is fast broken? If yes, is Kaffarah required?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, kissing one’s spouse while fasting without any exchange of saliva is permissible provided that there is no fear of it leading to something that will invalidate the fast. As for kissing one’s spouse in a manner wherein saliva is exchanged, i.e., making out, this will invalidate the fast and necessitate qadhaa and kaffaarah.
