Leave Muzdalifah before Fajr

Fatwaa ID: 1578

Question:

Assalamualaikum, I wanted to ask

If in Muzdalifah you pray maghrib and isha but leave the place around 2ish in the morning and walk towards jamarat before fajr whilst performing Hajj would that mean you have to give Dum?

It was 3 ladies and one male performing the hajj at the time.

Jazakallah khair.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, if a healthy and fit pilgrim misses the Wuqūf of Muzdalifah, which is Waajib, i.e., between Subh Saadiq (true dawn) and Sunrise of the 10th of Dhul Hijjah, then he has to give one dumm in the Hudoodul Haram/ Makkah boundaries.

In the enquired query, if the Wuqūf was missed by them, i.e., they left before Subah Saadiq due to a Shari’i excuse or reason like severe sickness, weakness and fear of stampede type of huge crowd, then their will be no dumm on the female pilgrims. For males, the first two are valid reason, not the third; there is dumm in the last type of excuse.

If they did not have any Shari’i legitimate excuse, then each one of them should slaughter one dumm in the Hudoodul Haram.

And Allaah Ta’aala knows best.
