Making tawaaf and leading salaah in only underwear

Question:
I am a follower of the maliki mathab.i would like to know if it is permissible for me to make tawaaf wearing only an underwear, since the thighs don’t consitute as awrah according to our mathab.

Furthermore if I decide to make Imamat wearing nothing but an underwear, I guess it should be permissible for me.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

The authoritative position of the Maaliki legal school, especially in front of people, is that the thighs are from the ‘awrah. They must remain covered. The ‘awrah of a man is from the navel to the knee. Accordingly, you may not make tawaaf only wearing an underwear. Likewise, you may not lead salaah while wearing an underwear only.

We wish to remind you that when doing either of the two, you must humble yourself and follow the appropriate etiquettes. When performing tawaaf or salaah, you should dress respectfully; you are in front of Allaah Ta’aala.

ﻭﺃﻣﺎ اﻟﻤﺴﺄﻟﺔ اﻟﺜﺎﻧﻴﺔ: ﻭﻫﻲ ﺣﺪ اﻝﻋﻮﺭﺓ ﻣﻦ اﻟﺮﺟﻞ ﻓﺬﻫﺐ ﻣﺎﻟﻚ ﻭاﻟﺸﺎﻓﻌﻲ ﺇﻟﻰ ﺃﻥ ﺣﺪ اﻝﻋﻮﺭﺓ ﻣﻨﻪ ﻣﺎ ﺑﻴﻦ اﻟﺴﺮﺓ ﺇﻟﻰ اﻟﺮﻛﺒﺔ، ﻭﻛﺬﻟﻚ ﻗﺎﻝ ﺃﺑﻮ ﺣﻨﻴﻔﺔ، ﻭﻗﺎﻝ ﻗﻮﻡ: اﻝﻋﻮﺭﺓ ﻫﻤﺎ اﻟﺴﻮﺃﺗﺎﻥ ﻓﻘﻂ ﻣﻦ اﻟﺮﺟﻞ.
ﻭﺳﺒﺐ اﻟﺨﻼﻑ ﻓﻲ ﺫﻟﻚ ﺃﺛﺮاﻥ ﻣﺘﻌﺎﺭﺿﺎﻥ ﻛﻼﻫﻤﺎ ﺛﺎﺑﺖ: ﺃﺣﺪﻫﻤﺎ ﺣﺪﻳﺚ ﺟﺮﻫﺪ ﺃﻥ اﻟﻨﺒﻲ – ﺻﻠﻰ اﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ – ﻗﺎﻝ: «اﻟﻔﺨﺬ ﻋﻮﺭﺓ» . ﻭاﻟﺜﺎﻧﻲ: ﺣﺪﻳﺚ ﺃﻧﺲ «ﺃﻥ اﻟﻨﺒﻲ – ﺻﻠﻰ اﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ – ﺣﺴﺮ ﻋﻦ ﻓﺨﺬﻩ، ﻭﻫﻮ ﺟﺎﻟﺲ ﻣﻊ ﺃﺻﺤﺎﺑﻪ» .
ﻗﺎﻝ اﻟﺒﺨﺎﺭﻱ: ﻭﺣﺪﻳﺚ ﺃﻧﺲ ﺃﺳﻨﺪ ﻭﺣﺪﻳﺚ ﺟﺮﻫﺪ ﺃﺣﻮﻁ، ﻭﻗﺪ ﻗﺎﻝ ﺑﻌﻀﻬﻢ: اﻝﻋﻮﺭﺓ اﻟﺪﺑﺮ، ﻭاﻟﻔﺮﺝ، ﻭاﻟﻔﺨﺬ.
