Bismillah hirrahman nirraheem.
Respected mufti, Assalamualaikum warehmatullahi wabarkatahu.
A sister was married to a muslim brother(say X) and got divorced after 4yrs. She has a baby girl from X. She then got married to another brother ( say Y) which lasted for 10years and blessed with 2 kids.
Under such a situation is it advisable/legal ruling to seek marriage again with Mr.X and become second wife?. Also is it necessary for MrX to adopt the 2 kids which she had from Y. Please advise with any hadith reference if applicable.
Jazak Allahu khair

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
We take note of the details the query.
- It is the lady’s personal choice. If she wishes to now get married again to her first husband, then that is permissible. We are not in a position to advise what is appropriate for her. She should perform istikhaarah, consult with her well wishers, apply her due diligence and make a decision from there.
- The first husband is not legally obligated to adopt nor take care of his stepchildren. However, if he does, his rewards will be tremendous.
And Allaah Ta’aala knows best.
