Marrying a divorced lady with a baby

Fatwaa ID: 2299

Assalamualaikum mufti, I want to marry a girl who is divorced and have a baby, she had done nikah after conceiving the baby. Is that even valid?, she had multiple relationships including with my cousin. But she repented and made sincere taubah, now we have been together since 5 years and she completely changed she prays, reads quran, and every basic thing which is to be done, now I want to marry her and I don’t want to explain her past to my parents and family as they will never accept, so when asked I hide and said that it was nothing but just rumor, and even the nikah which was done has no paper no written proof or nothing, please guide me to the best. Even the girl and her family don’t want to people know about her past. There were few ppl in my house who were talking behind me about this. Please guide.

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

At the outset, we wish to remind you that your relationship with her is haraam. You state that “we have been together since 5 years” but you only wish to marry her now. If she had truly changed, then she would not have allowed for such a relationship. We advise you to refrain from haraam relationships. They will only bring about regret and remorse. If you are interested in marrying her, then proceed with the nikaah as soon as possible. Until then, refrain from unnecessary contacts.

Nevertheless, it is permissible for you to marry the divorced lady in question if you feel that she is compatible with you and that she has sincerely changed her life for the better. Remember, your decision should be rational and well-thought. It should not be based on emotions. You are choosing a life partner and the mother of your children. Make istikhaarah and consult with your well-wishers before making a decision.

In all cases, you should not reveal her past to anyone including your family and close ones. Her past is between her and Allaah Ta’aala. To expose her sins to others is haraam and sinful. Likewise, should you marry her, it will not be permissible for you to bring up the past and/or use it against her. You are marrying her knowing and accepting her past.

And Allaah Ta’aala knows best.
