Marrying a Murtad

Fatwaa: 005

Question:

I am asking this question for my sister who is 24 yrs. old , she was approached a guy who is asking to marry her, although he was born a Muslim he disclosed this fact that he does not believe in Allah SWT. This happened after she talked to him 6-7 times, he thinks Islam is a grat religion but we belong to a religious family and now she us very confused what should she do is it a sin to marry such a person who has good character and all good traits and respectful, is she supposed to convince him or end this all by saying that the guy is not Muslim at all. Please answer in light of Islam and as soon as possible, she’s losing her mind over this JaZakAllah

Answer:

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

Brother in Islaam, 
When a person gets married, the most essential aspect to consider is the Imaan of a person and his/her righteousness. Other aspects and considerations are secondary. You state that he disclosed the fact that he does not believe in Allaah Ta’aala. Accordingly, he is not a Muslim. It is impermissible to marry a non-Muslim[1]. Your sister cannot marry the person.

{وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُون}

[سورة الممتحنة: 10]

{فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ} 

الأصل للشيباني (10/ 220)

وإذا ارتد الرجل عن الإسلام ثم تزوج في حال ردته امرأة مرتدة أو من أهل الكتاب أو مسلمة فإن ذلك باطل، لا يجوز النكاح؛
