Maybe I give you divorce

Fatwaa ID: 268

Question:
Assalamu alaykum.
May I ask if a husband said it in the state of angry “maybe I give you divorce” then women says “give me divorce”.
So does this terminate in divorce depending on husbands intention?
Jazakumullah Khayran
So after wife asked for it the second time, he didn’t reply to that.

Clarification: Assalamu alaykum Mufti Sahib.
Apologies for the delay. I tried to ask but he didn’t respond, I’m not sure if he remembers or he just doesn’t want to clearly mention. Would you kindly share some advice if his words/indication could be a reference to actual divorce.
I would appreciate it just though we are content he’s not close to haram if he does stay with his spouse.
JazakAllahu Khayran

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We take note of the details of your query. The statement in reference did not constitute a talaaq unless the husband intended that. He should be asked to fear Allaah Ta’aala and make a sincere decision.

And Allaah Ta’aala knows best.
