Missing Jumu’ah salaah to secure Hajj package on Nusuk

Fatwaa ID: 2231

Question:
Assalamu alaikum Mufti Saab ,

It is said Nusuk system will allow another wave of Hajj packages to be purchased on Friday night Saudi time.

This corresponds to jumuah salah time in America.

Securing a Hajj package is extremely difficult now. Last week, the first wave of packages was released and some people waited in the online queue for 9+ hours. After waiting so long, the entire visa quota filled in about 35 minutes. 30,000 Americans competed for 3,500 seats.

Question: Since Hajj is such an important pillar, is it permissible to miss jumuah salah and pray Zuhr at home, in the hopes of securing a Hajj package on Nusuk?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We commend you for your zeal to fulfill a pillar of Islam. May Allaah Ta’aala bless you with such zeal in all aspects of Deen and keep you steadfast upon it.

At the outset, we wish to remind you that you can only go for Hajj if and when Allaah Ta’aala invites you. If He does not invite you, then you cannot go irrespective of how much you try. If you are invited, Allaah Ta’aala will facilitate for you a take you even without you doing much. That being said, Allaah Ta’aala does not need you to forgo your immediate obligation in an attempt to seek a potential or future obligation. Priorities must be considered.

At the time of Jumu’ah, your obligation and priority is to attend the Jumu’ah congregation. It will not be permissible for you to engage in anything else at that time. It will not be permissible for you to stay back at home and pray Zuhr instead so that you can attempt to secure a Hajj package. That will earn you the wrath of Allaah Ta’aala instead. We must do everything appropriately.

It should be remembered that if Hajj is obligatory upon you financially but you are unable to go due to issues such as the Nusuk system despite you trying your level best through legal and permissible means, then you would not be sinful. In such a case, you continue trying until it happens. If it does not happen during lifetime, then you should bequest for someone to perform it on your behalf after your demise.

And Allaah Ta’aala knows best.
