Musaafir completing salaah

Question:
السلام عليكم ورحمة الله وبركاته
If a person prays 4 rakas as a musafir instead of two is the Salah necessary to repeat? Is this the same whether the person realizes (that he was only supposed to pray two) within the time or after the time?

Also, I heard that a Maliki can pray 4 rakas as a Musafir instead of 2. If a Maliki leads a Hanafi in Salah then will the Hanafi have to repeat? And if the time for the prayer is over will he still have to repeat?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

  1. If a musaafir sat for tashahhud in the second rak’ah but performed four rak’ahs, then his salaah is valid. However, it is waajib to repeat it if there is time remaining for that salaah. If there is no time remaining, then it does not have to be repeated but he should make istighfaar. If he did not sit for tashahhud in the second rak’ah, then the salaah was invalid and must be repeated in all cases.
  2. The salaah of the muqeem Hanafi muqtadee will be invalid if the musaafir imaam performs full salaah. It must be repeated whether there is time remaining or not. As for the salaah of the musaafir Hanafi muqtadee behind him, his salaah will be valid provided that the imaam sat for tashahhud in the first sitting. If time is remaining, this it is waajib to repeat it. If he did not sit, then salaah will have to be repeated in all cases.
