Musafir when visiting the husband

Question:
السلام عليكم و رحمة الله و بركاته
A sister recently got married. She has not permanently moved to her husband’s place as she has a placement to complete.
She will be staying at her parents for the next 6 months or so, and will stay at her husband’s for the weekend (2 days)
Would this mean the wife will be praying traveller’s prayer when she’s at her husband’s place until she has permanent residence there?

Answer:

May Allaah Ta’aala bless her marriage with love, happiness and unity.

Is the distance between the two safar distance? If so, then she will make qasr of the applicable salaahs when visiting her husband’s place until she moves in. She is only visiting her husband for now. This is with mutual understanding between the couple. She is not subject to the laws of safar and iqaamah applicable to her husband in the enquired situation.

ﻭﻟﻮ ﺃﻥ اﻣﺮﺃﺓ ﺳﺎﻓﺮﺕ ﻣﻊ ﺯﻭﺟﻬﺎ ﻓﻨﻮﻯ ﻫﻮ ﺃﻥ ﻳﻘﻴﻢ ﻓﻲ ﻣﻮﺿﻊ ﺧﻤﺴﺔ ﻋﺸﺮ ﻳﻮﻣﺎ ﻓﻌﻠﻴﻬﺎ ﺃﻥ ﺗﺼﻠﻲ ﺃﺭﺑﻌﺎ، ﻭﺇﻥ ﻟﻢ ﺗﻨﻮ اﻹﻗﺎﻣﺔ.
ﻭﻟﻮ ﺃﻧﻬﺎ ﻧﻮﺕ اﻹﻗﺎﻣﺔ ﺩﻭﻥ اﻟﺰﻭﺝ ﻛﺎﻥ ﻋﻠﻴﻬﺎ ﺃﻥ ﺗﺼﻠﻲ ﺭﻛﻌﺘﻴﻦ؛ ﻷﻧﻬﺎ ﺗﺎﺑﻌﺔ ﻟﻠﺰﻭﺝ ﻓﻲ اﻟﺴﻔﺮ ﻭاﻹﻗﺎﻣﺔ ﻗﺎﻝ اﻟﻠﻪ ﺗﻌﺎﻟﻰ {ﺃﺳﻜﻨﻮﻫﻦ ﻣﻦ ﺣﻴﺚ ﺳﻜﻨﺘﻢ} [ اﻟﻄﻼﻕ: 6] . ﻭﻗﺎﻝ اﻟﻠﻪ ﺗﻌﺎﻟﻰ {اﻟﺮﺟﺎﻝ ﻗﻮاﻣﻮﻥ ﻋﻠﻰ اﻟﻨﺴﺎء [ اﻟﻨﺴﺎء: 34] ، ﻭﺇﻧﻤﺎ ﻳﻌﺘﺒﺮ ﺗﻐﻴﺮ اﻟﻨﻴﺔ ﻣﻤﻦ ﻫﻮ ﺃﺻﻞ ﺩﻭﻥ ﻣﻦ ﻫﻮ ﺗﺒﻊ؛ ﻷﻥ ﺛﺒﻮﺕ اﻟﺤﻜﻢ ﻓﻲ اﻟﺘﺒﻊ ﺑﺜﺒﻮﺗﻪ ﻓﻲ اﻷﺻﻞ ﻭﻣﻦ ﺃﺻﺤﺎﺑﻨﺎ ﻣﻦ ﻳﻘﻮﻝ ﻫﺬا ﺇﺫا ﻛﺎﻧﺖ ﻗﺪ اﺳﺘﻮﻓﺖ ﺻﺪاﻗﻬﺎ ﻓﺈﻥ ﻟﻢ ﺗﻜﻦ اﺳﺘﻮﻓﺖ ﺻﺪاﻗﻬﺎ ﻭﻟﻢ ﻳﺪﺧﻞ ﺑﻬﺎ اﻟﺰﻭﺝ ﻓﺈﻧﻬﺎ ﺗﻌﺘﺒﺮ ﻧﻴﺘﻬﺎ؛ ﻷﻥ ﻟﻬﺎ ﺃﻥ ﺗﺤﺒﺲ ﻧﻔﺴﻬﺎ ﻻﺳﺘﻴﻔﺎء اﻟﺼﺪاﻕ ﻓﻼ ﺗﺨﺮﺝ ﻣﻊ ﺯﻭﺟﻬﺎ، ﻭﺇﻥ ﻛﺎﻥ ﻗﺪ ﺩﺧﻞ ﺑﻬﺎ ﻓﻌﻠﻰ اﻟﺨﻼﻑ اﻟﻤﻌﺮﻭﻑ ﻓﻲ ﺛﺒﻮﺕ ﺣﻖ اﻟﺤﺒﺲ ﻟﻬﺎ ﻻﺳﺘﻴﻔﺎء اﻟﺼﺪاﻕ، ﻭﻗﻴﻞ ﺑﻞ ﻫﻮ ﻗﻮﻟﻬﻢ ﺟﻤﻴﻌﺎ؛ ﻷﻧﻪ، ﻭﺇﻥ ﻛﺎﻥ ﻟﻬﺎ ﺃﻥ ﺗﺤﺒﺲ ﻧﻔﺴﻬﺎ ﻓﻤﺎ ﻟﻢ ﺗﺤﺒﺲ ﻛﺎﻧﺖ ﺗﺎﺑﻌﺔ ﻟﺰﻭﺟﻬﺎ، ﻭﺇﻧﻤﺎ ﻭﺿﻊ اﻟﻤﺴﺄﻟﺔ ﻓﻴﻤﺎ ﺇﺫا ﻧﻮﺕ اﻹﻗﺎﻣﺔ ﺃﻭ اﻟﺴﻔﺮ ﻣﻦ ﻏﻴﺮ ﺃﻥ ﻗﺼﺪﺕ ﺣﺒﺲ ﻧﻔﺴﻬﺎ ﻋﻦ ﺯﻭﺟﻬﺎ ﻭﻋﻠﻰ ﻫﺬا ﺣﻜﻢ ﻛﻞ ﺗﺒﻊ ﻣﻊ ﺃﺻﻠﻪ ﻛﺎﻟﻌﺒﺪ ﻣﻊ ﺳﻴﺪﻩ ﻭاﻷﺟﻴﺮ ﻟﻠﺨﺪﻣﺔ ﻣﻊ اﻟﻤﺴﺘﺄﺟﺮ ﻭاﻟﺠﻨﺪﻱ ﻣﻊ اﻟﺴﻠﻄﺎﻥ ﺇﻧﻤﺎ ﻳﻌﺘﺒﺮ ﻧﻴﺔ اﻹﻗﺎﻣﺔ ﻭاﻟﺴﻔﺮ ﻣﻤﻦ ﻫﻮ ﺃﺻﻞ ﺩﻭﻥ اﻟﺘﺒﻊ، ﻭﺇﻥ ﻛﺎﻥ اﻟﺰﻭﺝ ﺃﻭ اﻟﺴﻴﺪ ﺧﻠﻰ ﺑﻴﻦ اﻟﻤﺮﺃﺓ ﻭاﻟﻌﺒﺪ ﻭﺑﻴﻦ اﻟﻨﻴﺔ اﻵﻥ ﺗﻌﺘﺒﺮ ﻧﻴﺘﻬﻤﺎ؛ ﻷﻧﻬﻤﺎ ﺻﺎﺭا ﺃﺻﻠﻴﻦ ﺑﻬﺬﻩ اﻟﺘﺨﻠﻴﺔ ﻣﺎ ﻟﻢ ﻳﺮﺟﻊ اﻟﺰﻭﺝ، ﻭاﻟﺴﻴﺪ ﻋﻨﻬﺎ
