Niece’s husband

Fatwaa ID: 2045

Question:
Assalamalaikum Mufti Sb.
I have one question kindly clarify.
One lady who is above 75 years of age wants to go for umrah from India. She will be going with her sister and sister’s 2 daughters and their husbands.
So can she travel with them for umrah or she still needs mahram?
Her sister has a son who will be joining them from canada after 4 days. Can he be her mahram?
Please guide.
Jazakallah khairan

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, the husband of one’s niece is not a mahram. The laws of hijaab and inter-gender interactions will be applicable between them. They cannot travel together without the aunt-in-law’s mahram.

In the enquired situation, it will not be permissible for the elderly aunt to travel for ‘Umrah with her nieces’ husbands even though the nieces are present. The nephew coming a few days later does not make a difference. They must be together for the entire time from the beginning of the travel to the end.

And Allaah Ta’aala knows best.
