Niyyah of kaffaarah fast and oath fast together

Question:
Assalamoalikum,

A person X broke promise to Allah multiple times and cannot feed or cloth poor so he can only fast for kaffarah. On the other hand he has to make Qaza fasts for ramadan. please guide which one to do first qaza fast or three fasts for each broken promise or can make niyat for both at same time.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

At the outset, the kaffaarah for breaking an oath is to feed ten people two average meals or clothe ten people sufficient clothes to adequately cover their body. Most are able to fulfill this. If one is genuinely unable to do either of the above due to not having the financial means, and Allaah Ta’aala knows the reality of his situation, then he must fast three consecutive days. Along with the above, tawbah and istighfaar must be made.

Nevertheless, keeping the above in mind, if he is eligible to fast and he also has missed fasts of Ramadhaan to make qadhaa of, then he should give preference to the Ramadhaan qadhaa fasts. That is stronger in terms of obligation than the other. However, if one observes the other fast first, that will be valid. As for combining both intentions, that will not be permissible. One niyyah can be made only in the enquired situation.
