Opening the fast with intercourse

assalamu alaykum mufti sahib.
Is it permissible for a husband/wife to open their fast with intercourse when they hear the azan for maghrib?

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

It is permissible for a married couple to open their fast with intimacy. However, the blessed sunnah of Nabi ﷺ was to open the fast with dates and water. Furthermore, if intimacy leads to intercourse, then ghusl would become necessary and that may result in a delay of the Maghrib Salaah. That is reprehensible.

As for the famously quoted narration regarding Sayyiduna ‘Abdullaah ibn ‘Umar (R) that he would do iftaar by engaging in intimacy with his wife, then that was not his sunnah nor common practice. It may have been occasionally to relieve a pulsating sexual tension at that moment or because he did not have any food available for iftaar.

ﻭﺭﻭﻳﻨﺎ ﻋﻦ اﺑﻦ ﻋﻤﺮ ﺃﻧﻪ ﻛﺎﻥ ﺭﺑﻤﺎ ﺃﻓﻄﺮ ﻋﻠﻰ اﻟﺠﻤﺎﻉ، ﺭﻭاﻩ اﻟﻄﺒﺮاﻧﻲ ﻣﻦ ﺭﻭاﻳﺔ ﻣﺤﻤﺪ اﺑﻦ ﺳﻴﺮﻳﻦ ﻋﻨﻪ، ﻭﺇﺳﻨﺎﺩﻩ ﺣﺴﻦ، ﻭﺫﻟﻚ ﻳﺤﺘﻤﻞ ﺃﻣﺮﻳﻦ: ﺃﺣﺪﻫﻤﺎ: ﺃﻥ ﻳﻜﻮﻥ ﺫﻟﻚ ﻟﻐﻠﺒﺔ اﻟﺸﻬﻮﺓ ﻭﺇﻥ ﻛﺎﻥ اﻟﺼﻮﻡ ﻳﻜﺴﺮ اﻟﺸﻬﻮﺓ. ﻭاﻟﺜﺎﻧﻲ: ﺃﻥ ﻳﻜﻮﻥ ﻟﺘﺤﻘﻖ اﻟﺤﻞ ﻣﻦ ﺃﻫﻠﻪ، ﻭﺭﺑﻤﺎ ﻳﺮﺩﺩ ﻓﻲ ﺑﻌﺾ اﻟﻤﺄﻛﻮﻻﺕ. ﻭﻓﻲ (اﻟﻤﺴﺘﺪﺭﻙ) : ﻋﻦ ﻗﺘﺎﺩﺓ ﻋﻦ ﺃﻧﺲ ﺃﻥ اﻟﻨﺒﻲ ﺻﻠﻰ اﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻛﺎﻥ ﻻ ﻳﺼﻠﻲ اﻟﻤﻐﺮﺏ ﺣﺘﻰ ﻳﻔﻄﺮ، ﻭﻟﻮ ﻋﻠﻰ ﺷﺮﺑﺔ ﻣﻦ ﻣﺎء، ﻭﺫﻫﺐ اﺑﻦ ﺣﺰﻡ ﺇﻟﻰ ﻭﺟﻮﺏ اﻟﻔﻄﺮ ﻋﻠﻰ اﻟﺘﻤﺮ ﺇﻥ ﻭﺟﺪﻩ. ﻓﺈﻥ ﻟﻢ ﻳﺠﺪﻩ ﻓﻌﻠﻰ اﻟﻤﺎء، ﻭﺇﻥ ﻟﻢ ﻳﻔﻌﻞ ﻓﻬﻮ ﻋﺎﺹ، ﻭﻻ ﻳﺒﻄﻞ ﺻﻮﻣﻪ ﺑﺬﻟﻚ.

حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الْحُسَيْنِ، حدثنا مُحَمَّدُ بْنُ إِسْحَاقَ، حدثنا مُؤَمَّلُ بْنُ هِشَامٍ، حدثنا أَبُو عَبَّادٍ يَحْيَى بْنُ عَبَّادٍ، عَنِ السَّرِيِّ بْنِ يَحْيَى، حدثنا مُحَمَّدُ بْنُ سِيرِينَ، قَالَ: ( رُبَّمَا أَفْطَرَ ابْنُ عُمَرَ عَلَى الْجِمَاعِ ).
وَعَنِ السَّرِيِّ، عَنْ عَبْدِ الْكَرِيمِ، عَنْ مُجَاهِدٍ، قَالَ: قَالَ ابْنُ عُمَرَ: ( لَقَدْ أُعْطِيتُ مِنْهُ شَيْئًا، لَا أَعْلَمُ أَحَدًا أُعْطِيهِ؛ إِلَّا أَنْ يَكُونَ رَسُولَ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ).
