Physician samples

Fatwaa ID: 1728

Question:
Several representatives of a pharmaceutical company visit us and provide us drug samples which are called ‘physician samples, not for sale’. As a doctor, I provided them to the poor patients and employees of my organization, relatives, and neighbors without any restriction. However, a great number of drugs remain without distribution, I mean although I freely distribute, many drugs remain unused and those drugs have expired. To prevent wastage, in the future, may I sell the extra drugs in the market at the lowest price that remained undistributed? Is it permissible?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We take note of the details of your query. May Allaah Ta’aala reward you for your kindness and good work. In principle, once something belongs to you, you have the full authority to do as you wish with it. You may give it away or sell it. However, you should be considerate of the fair legal laws and restrictions in your country and avoid unnecessary trouble and/or humiliation.

And Allaah Ta’aala knows best.
