Question:

Assalamualaikum,

Mufti Saheb I have one question regarding purity of water in storage tank…

We have 1000ltr HDPE storage tank at our home which was partially filled with water,  yesterday when we were filling the tank it was mixed with impure water coming from the main line resulting change in taste, colour and odour. we notice this after some time and stopped the pump and open all taps to drain the tank..

But still some water must be trapped inside which can not be drain by opening the taps(faucet)

Next day when water from line was ok. we filled the tank upto the same level  and drained it by opening the taps, again filled it and started using water.. note that there was no odour or visible impurities…is this method is OK according to sharia and wadhu performed using water is valid??.if not please guide us to correct method.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You state the water from the main line was impure. How did you determine the main line was impure?

Assuming the water was impure, the draining of the water was sufficient[i]. When the tank was refilled and the water reached the volume of maa katheer (significant amount of water according to your honest discretion), the remaining impurity was insignificant. Thus, the water will be considered pure and wudhu performed from this water was valid.

وقال الفقيه أبو جعفر الهندواني: إذا دخل فيه الماء الطاهر، وخرج بعضه، يحكم بطهارته بعد أن لا تستبين فيه النجاسة؛ لأنه صار ماء جاريا، ولم يستيقن ببقاء النجس فيه، وبه أخذ الفقيه أبو الليث، وقيل: إذا خرج منه مقدار الماء النجس يطهر، كالبئر إذا تنجست، أنه يحكم بطهارتها بنزح ما فيها من الماء وعلى هذا حوض الحمام أو الأواني إذا تنجس.

وَقيل إِذا خرج مِنْهُ مِقْدَار المَاء النَّجس يطهر كالبئر إِذا تنجست تطهر بنزح مَا فِيهَا من المَاء

ولو تنجس حوض الماء فدخل فيه ماء حتى خرج مثله يطهر

البحر الرائق شرح كنز الدقائق ومنحة الخالق وتكملة الطوري (1/ 90)

وإن استقر في حوض كبير فهو نجس أيضا ما دام متغيرا أو زال تغيره بنفسه أيضا

وأما إذا استمر الماء جاريا بعد ذلك إلى أن أتى الماء صافيا وزال تغير الحوض بذلك الماء الصافي، فإنه يطهر الماء كله سواء كان الحوض صغيرا أو كبيرا، وإن كان الزبل في أسفله راكدا ما دام الماء الصافي في ذلك الحوض يدخل من مكان ويخرج من مكان فإذا انقطع الجريان بعد ذلك، وكان الحوض صغيرا والزبل في أسفله راكدا فالحوض نجس إلى أن يصير الزبل الذي في أسفله حمأة، وهي الطين الأسود فلا يكون نجسا حينئذ، وإذا كان الحوض كبيرا فالأمر فيه يسير
