Raped by dad’s friend and then forced into marriage

Question:
A sister was raped by her dad’s friend and then blackmailed and forced into marriage. Her parents didn’t ask her but when Imam asked her she said yes. She had to say yes or her parents would have beaten her and man said he would tell about her rape and make her impossible to marry anyone else

She wants to know if she can get a divorce without the man agreement, because she was blackmailed, and raped into this marriage

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

May Allaah Ta’aala grant her the strength to heal from her trauma. May He grant her comfort and happiness. May He give the despicable and caitiff rapist whatever he deserves in this life and the next and bring about justice.

The attitude of the parents are unbecoming. Shame on them. They have failed as parents to protect the honor and dignity of their daughter. They will be accountable for this on the Day of Judgment.

We advise her to refer her case to a reputable local Muslim judicial board and apply for faskh of the nikaah if she wishes to come out of the marriage. They will assess the case and preside over it. If there are valid grounds, then they will annul the marriage. If there are no valid grounds, then the only way out would be through a valid talaaq or khula’, both of which require the husband’s agreement.

We advise her to continue making du’aa for the best. She should make istikhaarah and mashwarah before any decision or action. She should frequently send salawaat upon Nabi ﷺ and also recite حسبنا الله ونعم الوكيل.
