Rental insurance

I got rental insurance for my apartment when I moved into an apartment as it was a legal requirement. After living for a few months, the water pipe in my apartment burst flooding the entire apartment, damaging the entire washroom as well as my furniture and other stuff. The apartment became unusable and the apartment management said that I had to move into a hotel until the apartment was repaired and ready to be used.

  1. Can I claim for the damages to my stuff?
  2. Can I claim the hotel’s rent for the period while my apartment is being repaired.

May Allaah Ta’aala make it easy for you and reimburse with even better than what you had. May Allaah Ta’aala bless you with khayr and ‘aafiyah.

In principle, all forms of conventional insurance, including rental insurance, is impermissible. This is due to the various haraam elements found in them. Accordingly, it will not be permissible to make claims from the insurance company for the damages or for hotel reimbursement except the amount that you have paid in policy premiums. Anything additional will have to be returned to them or given away in charity. If the insurance company gives you something without you having made a claim, then that would be permissible to accept. If the bursting of the water pipe was due to the negligence of the owner, then you may demand reimbursement from him.

We would like to commend you for your imaani consciousness. Allaah Ta’aala tests us in life in various ways. Sometimes it is with the loss of finances and wealth. Remain steadfast. Anticipate reward from Allaah Ta’aala. Surely he will bless you with something better. This is part of tawakkul and sabr that we have been commanded with.
