SLEEPING WHILST IN THE STATE OF WUDHU

Question:

Assalamo aleykum,

if I laid down a little bit with wudhu and closed my eyes and lost consciousness just a few seconds, does this break wudhu, knowing I am 100% sure and could take an oath I did not pass wind (ie I can feel the inner body condition is the same before I closed my eyes) ?

Answer:

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

You state that while lying down you closed your eyes and lost consciousness but you are confident you did not pass wind. 

In principle, if a person falls asleep even for a moment while lying down, his wudhu will break, irrespective of whether he is confident or not regarding passing of wind[1]. In the enquired situation, you wudhu had terminated.

قلت: أرأيت النوم هل ينقض الوضوء؟ قال: إذا كان قائما أو راكعا أو ساجدا أو قاعدا فلا ينقض وضوءه، وأما إذا نام مضطجعا أو متكئا فإن ذلك ينقض الوضوء. قال أبو يوسف: إن نام متعمدا في السجود فسدت صلاته، وإن غلبه النوم في السجود لم يضره. قلت: إن نام على إحدى أليتيه أو إحدى وركيه متوركا؟ قال: هذا ينقض وضوءه.

واما التي غير مثارة من موضع:

أحدها النوم وفيه ثلاثة أقوال فعند المزني تلميذ الشافعي يوجب الوضوء منه على كل حال وقع من الانسان

وعند الفقهاء لا يوجب الوضوء الا ان يكون متساندا او متوركا او متكئا أو مضطجعا وعند ابي عبد الله لا يوجب الوضوء الا ان يكون مضطجعا
