Unpaid mahr of deceased wife

Fatwaa ID: 1816

Wa rahmatullahi.
Wa barakatuhu.

One man wants to go for umrah.
He didn’t paid Maher to his wife.
His wife is no more.
What should he do before going to umrah.
Where should he spend the money of mahar ?

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

Mahr remains a debt on the husband until paid or pardoned. In the event that the wife passes away prior to receiving the mahr, the mahr will have to be given to her estate which will then be distributed amongst the rightful heirs according to their respective shares. The husband too is a rightful heir.

And Allaah Ta’aala knows best.
