Question:
2ndly Sheikh concerning inheritance if a husband passed away and he left wife, 5 kids behind the last she is still in the School is it allow to use the deceased money to settle the school fees because no any means to pay before the sharing begin Jazakallahu khair

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

We take note of the details of the query. In the enquired situation, it will be permissible to use from the funds of the estate to cover the necessary expenses of the bereaved children if no other funds are available for them. However, the amount used for each child will be deducted from his/her total when the estate is distributed. It should be noted that the estate ought to be distributed immediately without unnecessary delay.
