Using other people’s surnames

Question:
السلام عليكم ورحمة الله وبركاته
Respected mufti sahib
What’s is the ruling with regards to 2 brothers Fareed and Junaid (not real names)
Both are married and has children but Fareeds wife and children are on Junaids surname legally for paperwork in order for them to be legal in the country?

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

At the outset, it is important to understand that a surname does not have any religious importance. It is something that came about in recent times. In the enquired situation, it is not clear why two brothers have different surnames. Siblings, unless half or step, often share the same surname.

Nevertheless, the deception or fraudulent activity in the enquired situation will not have any effect on their marriages. As for the issue itself, this is contrary to the values of a Muslim. A Muslim ought to be honest and truthful. Furthermore, if caught, the individuals may be legally published and suffer other forms of humiliation. A Muslim must maintain his dignity and live an honorable life. Istighfaar should be made in the enquired situation.
