Is online/Skype Video Call Nikkah valid if the Bride is overseas and the Groom, Imam and two witnesses are in a different location (all of them at the same place except the Bride).
for reference the Bride is an adult who have been previously married and divorced and wish to remarry. However unable to travel for the nikkah for the time being.
Can the Nikkah be conducted via Skype Video Call so the identification of all be verified and the 2 Witnesses, Groom and Imam will all be in one place.
Please advise if Nikkah can be performed this way and if it will be valid.
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
We take note of the details of your query. Nikaah cannot be performed in the above manner. It will be invalid. For the validity of the nikaah, it is necessary that the bride and groom, or their representatives, and the two witnesses are all in one physical location. A video call will not fulfill this condition.
Alternatively, the bride may appoint the imaam or someone else besides the groom and the witnesses as her representative (wakeel). They will act on her behalf in the nikaah ceremony and accept the proposal on her behalf. The nikaah will be valid in this manner. The bride may witness the ceremony virtually if she wants to; this will not affect the ceremony.
And Allaah Ta’aala knows best.
